End-user license agreement (EULA)

1. Eligibility

You must be at least 18 years of age to download, install, or use Old Glory VPN or to purchase a subscription. By using the Service, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into a binding agreement. If you are under 18, you are not permitted to use the Service.

2. Ownership & License Grant

The Application is licensed, not sold, to you. Upon your payment of applicable subscription fees and your acceptance of this Agreement, Old Glory VPN grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Application solely for your personal, non-commercial purposes, strictly in accordance with the terms of this Agreement.

Old Glory VPN utilizes white-label software provided by a third-party technology partner to deliver the VPN Service. All intellectual property rights in the underlying technology remain with the respective rights holders.

3. Subscription Plans & Device Licensing

3.1 Available Plans

Old Glory VPN currently offers the following subscription plans:

• 1 Device Monthly – A monthly subscription granting a license for use on one (1) device simultaneously, billed every month.

• 1 Device Annual – An annual subscription granting a license for use on one (1) device simultaneously, billed once per year.

• 3 Device Monthly – A monthly subscription granting a license for use on up to three (3) devices simultaneously, billed every month.

• 3 Device Annual – An annual subscription granting a license for use on up to three (3) devices simultaneously, billed once per year.

3.2 Subscription Terms & Automatic Renewal

Old Glory VPN offers Monthly and Annual subscription options. Your subscription will automatically renew at the end of each billing period (monthly or annual, as applicable) unless you cancel prior to the renewal date.

A renewal notice will be sent to your registered email address before your payment method is charged. It is your responsibility to ensure your email address and billing information are current at all times. Old Glory VPN reserves the right to process renewal charges up to 30 days prior to the expiration date to avoid a lapse in service.

If you do not wish to renew, you must cancel your subscription before the end of the current billing period.

3.3 No Refund Policy

ALL SALES ARE FINAL. OLD GLORY VPN DOES NOT OFFER REFUNDS UNDER ANY CIRCUMSTANCES, INCLUDING BUT NOT LIMITED TO CANCELLATIONS, UNUSED SUBSCRIPTION PERIODS, OR DISSATISFACTION WITH THE SERVICE. By completing a purchase, you acknowledge and agree to this no-refund policy.

4. VPN Service & No-Logs Policy

Old Glory VPN provides a Virtual Private Network (VPN) service designed to encrypt your internet connection and protect your online privacy.

4.1 Strict No-Logs Policy

Old Glory VPN maintains a strict no-logs policy. The Service is provided by an automated process, and your activities while using it are not monitored, recorded, logged, stored, or passed to any third party. We do not store:

• Connection timestamps or session information

• Traffic logs or browsing activity

• IP addresses (originating or assigned)

• Bandwidth or usage data

Note: To enforce proper license usage and prevent abuse, an automated system temporarily retains your username and a timestamp of your active session status only while the session is active. This data is deleted immediately upon session termination.

4.2 Service Availability

VPN service coverage, speeds, server locations, and quality may vary and are subject to factors beyond our control, including but not limited to third-party service failures, network congestion, transmission or equipment issues, and interference. Old Glory VPN does not guarantee uninterrupted, error-free, or continuously available service.

Old Glory VPN may impose usage limits, suspend service, or terminate accounts in its sole discretion to protect users or the integrity of the network.

5. Payment & Billing

Payments are processed securely through Shopify Payments. By subscribing to Old Glory VPN, you authorize us to charge your payment method for the applicable subscription fees on a recurring basis.

Old Glory VPN does not store your full payment card details. Payment information is handled by our third-party payment processor in accordance with their applicable security standards and privacy policies.

6. Data Retention & Your Rights

Old Glory VPN may retain your name and payment information for the purpose of facilitating subscription renewals. This data is not used for any other purpose.

You have the right to request the removal of your personal information from our systems at any time. To submit a data deletion request, please contact us using the information provided at the end of this Agreement. We will process your request in a timely manner, subject to any applicable legal obligations.

7. Acceptable Use Policy

You agree to use Old Glory VPN only for lawful purposes and in a manner that does not infringe upon the rights of others or restrict or inhibit anyone else's use and enjoyment of the Service. You expressly agree NOT to use the Service to:

• Engage in any illegal, unlawful, fraudulent, or criminal activity

• Transmit, distribute, or store any material that violates applicable law or third-party rights

• Perform unauthorized access, hacking, or disruption of any network or system

• Send unsolicited bulk email (spam) or engage in any form of network abuse

• Consume excessive or unreasonable bandwidth that negatively impacts other users

• Use automated tools to maintain artificially continuous connections

• Violate the terms of service of any third-party platform or service accessed through the VPN

Old Glory VPN reserves the right, at its sole discretion, to suspend or terminate your access without notice if it determines your use violates this Acceptable Use Policy or places an unreasonable burden on the network.

8. Third-Party Services

The Service relies on third-party technology and infrastructure providers. Old Glory VPN shall not be responsible for the availability, accuracy, or performance of any third-party services. Third-party services are provided "as is" and subject to the terms and conditions of their respective providers.

Third-party links or integrations made available through the Service are provided solely for your convenience. You access and use them entirely at your own risk.

9. Restrictions

You agree not to, and shall not permit others to:

• License, sell, rent, lease, assign, distribute, or otherwise commercially exploit the Application

• Copy or use the Application for any purpose other than as expressly permitted by this Agreement

• Modify, create derivative works of, decompile, disassemble, decrypt, or reverse engineer any part of the Application

• Remove, alter, or obscure any proprietary notice, copyright, or trademark in the Application

• Use the Application on more devices than permitted under your purchased plan

10. Intellectual Property

The Application, including all copyrights, trademarks, trade secrets, and other intellectual property rights, are and shall remain the sole and exclusive property of Old Glory VPN and/or its licensors. Nothing in this Agreement shall be construed as transferring any ownership rights to you.

11. Communications

By registering for Old Glory VPN, you agree that we may contact you via email regarding:

• License expiration or renewal notices

• Changes to your subscription plan or pricing

• Service updates, maintenance, or interruptions

• Important security or account notifications

You may opt out of non-essential marketing communications at any time by following the unsubscribe instructions in any email we send.

12. Modifications to the Application & Agreement

Old Glory VPN reserves the right to modify, update, suspend, or discontinue the Application or any part of the Service, with or without notice, and without liability to you.

We may also amend this Agreement from time to time. If a revision is material, we will provide at least 30 days' notice prior to new terms taking effect via email to your registered address. Your continued use of the Application after any revision becomes effective constitutes your acceptance of the updated terms.

13. Term & Termination

This Agreement remains in effect until terminated by you or by Old Glory VPN.

Old Glory VPN may, at its sole discretion and at any time, suspend or terminate this Agreement with or without prior notice. This Agreement will terminate immediately, without prior notice, if you fail to comply with any provision herein.

You may terminate this Agreement at any time by canceling your subscription and uninstalling the Application from all devices. Termination does not entitle you to any refund.

Upon termination, you shall immediately cease all use of the Application. Termination shall not limit any rights or remedies of Old Glory VPN at law or in equity.

14. Disclaimer of Warranties

THE APPLICATION AND SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OLD GLORY VPN EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

OLD GLORY VPN DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR THAT IT WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS. NO VPNSERVICE CAN GUARANTEE COMPLETE ANONYMITY.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OLD GLORY VPN AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF PRIVACY, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OLD GLORY VPN'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING UNDER THIS AGREEMENT EXCEED THE TOTAL AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

16. Indemnification

You agree to indemnify, defend, and hold harmless Old Glory VPN and its owners, affiliates, officers, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of this Agreement or any applicable law or regulation; or (c) your violation of any rights of a third party.

17. Export Compliance

You may not export or re-export the Application except as authorized by the laws of the United States. In particular, the Application may not be exported or re-exported to any country subject to a U.S. embargo, or to any person on the U.S. Treasury Department's list of Specially Designated Nationals or the U.S. Department of Commerce Denied Persons List or Entity List.

18. Governing Law & Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts located in the State of Delaware.

This Agreement shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods.

19. Severability

If any provision of this Agreement is held to be unenforceable or invalid by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions of this Agreement shall continue in full force and effect.

20. Waiver

The failure of Old Glory VPN to enforce any right or provision of this Agreement shall not constitute a waiver of that right or provision. Any waiver of any provision of this Agreement will be effective only if in writing and signed by an authorized representative of Old Glory VPN.

21. Entire Agreement

This Agreement, together with the Old Glory VPN Privacy Policy, constitutes the entire agreement between you and Old Glory VPN with respect to the Service and supersedes all prior and contemporaneous agreements, understandings, and representations, whether written or oral.
